IMMIGRATION PROBLEM - AFTER SERVING PRISON SENTENCE THE SAGA CONTINUES
CONTROLLING the United Kingdom borders is now vested in the new name of Borders and Immigration Agency but do not make a mistake, this is part of the Home Office.
What has happened is that a Department has now been created mainly and specifically for the Boarder Control. Coming to think of it, this name sounds more relevant to the jobs of Immigration Officers because their job is to control those coming to and going out of United Kingdom, and as such I think we should all get familiar with the name and especially when a letter is received from them.

One client rushed in recently that he received a letter from the Borders and Immigration Agency and he felt the letter was from his Landlord trying to put a fright in his bonnet to vacate his house. The poor man went to beat up his landlord, well, it follows that he was arrested. I eventually explained to him that Boarders and Immigration Agency is part of the Home Office and he has just received a refusal letter from the Home Office. |
Anyway, today's article concentrates on the effect of using false instrument i.e. doggy documents which includes Passport, Driver's Licence and National Insurance Number, either to obtain a job or to open a bank account, or even to apply for Provisional Drivers Licence.
The effect of this, (if caught) is that you could be sentenced to Prison for up to 12 months. It does not matter whether you have your indefinite leave to remain or not, the end result is that the Borders and Immigration Agency will then issue you a deportation order. The Secretary of State will make the order by virtue of Section 3(5)(a) of the Immigration Act 1971 (as amended by the Immigration and Asylum Act 1999). In most if not in all cases, once you have been convicted of an offence, expect the Secretary of State to follow up, immediately or as soon as your prison sentence is coming to an end. The saga continues!
Having said this, you will almost certainly be given the chance to appeal such decision under section (82)(1) of the Immigration and Asylum Act 2002 and you will be given the Appeal Forms - Please take this to your Lawyer immediately and do not try to be your own Lawyer, it could land you in more trouble than you envisaged. This is what happened to Sumbo a well educated African man Manchester.
Sumbo has been in the United Kingdom for nearly 9 years and he did his studies through various training agencies and he has obtain certificates in Care work which includes "Weight lifting" Mouth to Mouth resuscitation, medication, and you name it he has done it all in the care industry, however, he has been using a passport he obtained by using a dead man's birth Certificate - in those days it was easy to obtain a birth certificate from Strand - you know what I mean?.
To be honest, Sumbo has forgotten his real name because he is so used to be called Derrick Smith by his numerous employers. No need to refer to Sumbo unless by those that knew him from obodo Niger, otherwise, to any other person he is Derrick with double RR.
All passport carry issue date and expiring date. Derrick passport is about to expire, he will need to renew, afterwards, he has travelled to Nigeria several times on the same passport and with Nigeria Visa, Europe was no problem, mortgage was not a problem and of course as standard he had various credit cards thrown at him. He has covered his face with and English name and all traces of Nigerian name removed from his household.
Derrick sent his passport for renewal with confidence. He was expecting a new passport but instead he got a letter inviting him to attend for the new face to face interview before the issuance of his new passport. This is the first time in 9 years that Derrick actually repeated his Nigerian name to himself when he went "Sumbo wahala wo leleyi" meaning "Sumbo what sort of trouble is this now" why are they calling me for interview? He asked himself various questions but he could not provide an answer!.
At the end, he invokes courage and decided to go for the interview. It did not take long before our Sumbo was arrested at the end he was convicted of using false instrument; he served 8 months in Prison this was after he has been in Prison custody for 3 months.
A week before his release date, he was served a deportation order! And the saga continues. Sumbo is now waiting to know his faith in the hands of an Immigration Judge. Folks, does it really worth it?. So many years in the United Kingdom and yet you could be returned to your country with nothing to show for it apart from the conviction record. What would you say when you get back to your country? How would you start again?.
My only advice to you is not to do it! If you know you are using a Passport or any other document that does not legitimately belong to you, seek help right now before it is too late otherwise you will have yourself to blame.
Remember, if you are caught seek legal advice fast and do not try to do it yourself.
